These Terms of Service ("Terms") govern your use of armament.com.au (the "Site") and any purchase you make from Armament ("we", "us", "our"). By using the Site or placing an order, you agree to these Terms. Please read them together with our Privacy Policy, Shipping Policy and Refund & Returns Policy, which form part of these Terms.
Armament is a small business based in Tasmania, Australia.
1. Our products
We sell trading cards, collectibles and related accessories. Many items are second-hand, one-of-a-kind, or available in very limited quantities. We describe and photograph each item as accurately as we reasonably can, but minor variations in colour, centring, surface and condition are normal for collectible cards, and screen colours may differ from the physical item.
Stock shown on the Site reflects what is actually on hand. Occasionally an item may sell out or become unavailable before your order is processed.
2. Pricing
All prices are listed in Australian dollars (AUD). Postage is calculated and shown at checkout. We are a small business; unless an invoice states otherwise, GST is not charged. We try to keep pricing accurate, but if an item is listed at an obviously incorrect price due to an error, we may cancel the order and fully refund you (see clause 4).
3. Orders and acceptance
When you place an order you are making an offer to buy. A confirmation that we have received your order does not mean we have accepted it. We accept your order when we dispatch the item to you. Title and risk in the goods pass to you on delivery.
4. Cancellations by us
We may cancel an order (in whole or part) where an item is no longer available, where there has been a pricing or description error, or where we reasonably suspect fraud. If we cancel, we will let you know and refund any amount you have paid for the affected items.
5. Payment
Payments are processed securely by Stripe. We do not see or store your full card details. By paying, you agree to Stripe's terms in addition to ours. Orders are not dispatched until payment has cleared.
6. Your consumer rights
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these Terms limits or removes those rights. See our Refund & Returns Policy for how to make a claim.
7. Intellectual property and third-party rights
The Site's design, text and original images are owned by Armament and may not be copied or reused without permission. Player names, team names, league marks and card manufacturer brands belong to their respective owners; they are referenced only to describe the items we sell, and we are not affiliated with, endorsed by, or sponsored by any of them.
8. Liability
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or other law that cannot lawfully be excluded. Subject to that, and to the extent permitted by law, our liability for any claim relating to an item is limited to replacing the item or supplying an equivalent, or refunding the price you paid for it.
9. Changes to these Terms
We may update these Terms from time to time. The version published on the Site at the time you place an order is the version that applies to that order.
10. Governing law
These Terms are governed by the laws of Tasmania, Australia, and you and we submit to the courts of that State and the Commonwealth of Australia.
